Terms and Conditions for Ultimate trip to Ibiza with Malibu
These terms and conditions (the “Terms”) apply to the Promotion and will prevail in the event of any conflict or inconsistency with any other communications, including in-store or online advertising or promotional materials including bottle neck collars. Entry instructions are deemed to form part of these Terms. By participating in this Promotion, all entrants will be deemed to have accepted and be bound by these Terms. Please retain a copy of these Terms for your information.
1. Promoter: Pernod Ricard UK Limited, Building 7 Chiswick Park, 566 Chiswick High Road, London, W4 5YG. Please do not send entries to this address.
2. The Promotion will be managed Element London Limited (“Element”), on behalf of the Promoter. Element’s registered address is Unit 9 Featherbed Court, Mixbury, Brackley, NN13 5RN. Please do not send entries to this address.
3. Eligibility: Promotion open to residents of the United Kingdom (England, Scotland, Wales, and Northern Ireland) aged 18 years and over, except employees and families of the Promoter and its affiliate companies and agencies (including Element) and anyone professionally connected with the Promotion. Excludes residents of the Channel Islands and Isle of Man.
4. Promotional Period: The Promotional Period shall start at 00:00 on 1 January 2026 and end at 23:59 on 30 June 2026.
5. Entry Instructions
5.1 Access to the Promotion will be made available via QR codes:
(a) printed on bottle neck tags, which will be distributed in participating Booker stores and convenience stores; and
(b) on promotional posters and barkers, which will be placed in participating convenience stores.
5.2 By scanning a QR code, consumers will be directed to www.maliburumdrinks.com/win, where they must complete the entry form with their name and email address.
5.3 Only one entry per person. Entry via QR codes on Malibu bottle neck tags requires purchase.
6. The Prizes
6.1 There are two types of prizes to be won (together, the “Prizes”).
Monthly Digital Camera Prize:
6.2 One AGFAPHOTO digital camera will be awarded each month of the Promotional Period, totalling six (6) cameras.
6.3 Each draw will take place at the end of the relevant calendar month, and entries received during that month only will be eligible for that month’s draw.
6.4 Winners of a digital camera will remain eligible for the Ibiza Holiday draw (as described below).
Grand Prize – Ibiza Holiday
6.5 At the end of the Promotional Period, one entrant will be drawn at random from all valid entries received during the entire Promotional Period.
6.6 The winner, together with one (1) elected companion, will receive the Ibiza Holiday. It includes:
• Return flights from major UK airport to Ibiza.
• Return private airport transfers from Ibiza airport to the hotel accommodation in Ibiza.
• 5 nights’ stay at 4-star hotel accommodation on the Ibiza, based on sharing a double/twin room, with breakfast included.
• Full-day admission to a leading Ibiza beach club, including hire of a double poolside lounger and €150 bar tab for food/drink.
• Three-course dinner and drinks at a top local restaurant, up to the value of £100 per person including gratuity.
• £250 spending money (to be deposited into the Winner’s bank account).
6.7 Further Conditions of the Ibiza Holiday Prize
a) The Winner and their companion must travel at the same time with the same itinerary. The Winner must be one of the travelling parties.
b) The Winner of the Ibiza Holiday and their companion must be aged 18 or over as of the start date of this Promotion.
c) Economy flights available from major international airport in the UK only. Flights will be selected by the Promoter and not all routings will be available. Travel arrangements (including costs relating to public transport, fuel or parking) to and from the Winner or the companion’s home and the UK departure airport do not form part of the Ibiza Holiday and are the responsibility of the Winner and their travelling companion. The Promoter will cover the taxes and fees associated with the flights, as well as one checked luggage item per person.
d) Accommodation is based on two (2) adults sharing one (1) double occupancy room. Accommodation will be selected by the Promoter at their sole discretion. The Winner will need a current and valid credit/debit card with sufficient available funds in order to check in at the hotel for security deposit purposes.
e) The Promoter may appoint an independent travel agent to book and manage the Ibiza Holiday on its behalf. Once an itinerary has been agreed, any amendments or anything not expressly included in the itinerary (including any in-flight extras and additional hotel charges) will be at the expense of the Winner. If a booking is cancelled or a companion removed, no alternative tickets will be issued. The Ibiza Holiday will be subject to the additional terms and conditions of the booking agent which will be notified to the Winner at the time of booking.
f) The Ibiza Holiday must be booked and travelled within one year of the Winner receiving their notification email and once booked any amendments will be at the expense of the Winner. The Ibiza Holiday cannot be taken from 21st December – 2nd January (Christmas and New Year), over UK bank holidays or over Easter Sunday. The Winner must contact the Promoter with three preferred travel dates in three separate months no later than six weeks prior to departure.
g) The Winner and the companion are responsible for obtaining a current and valid passport and any other relevant travel documentation required for travel to Italy, at their own expense. The Winner and their companion must obtain travel insurance and any required vaccinations, health certificates, visas, and other documentation necessary to complete the itinerary at the time of travel.
h) In the event of any travel disruptions, including but not limited to the cancellation or rescheduling of flights, or if a companion is removed, no alternative tickets will be issued. The Promoter accepts no responsibility for arranging alternative transportation or covering any additional costs incurred. It is the sole responsibility of the Winner to make alternative arrangements and bear any associated costs in such circumstances. The Promoter recommends that the Winner obtains adequate travel insurance to cover these sorts of events.
i) All cash allowances listed will be sent via bank transfer to the Winner’s nominated account.
j) The Ibiza Holiday excludes domestic ground transfers, meals and drinks not explicitly mentioned in these Terms, hotel incidentals, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in these Terms.
k) Specific terms and restrictions may apply for the activities listed and will be provided upon booking.
l) All elements of the Ibiza Holiday are subject to availability. If all or any part of the Ibiza Holiday is unavailable, the Promoter may, in its absolute discretion, substitute all or any part of the Ibiza Holiday for an alternative prize of equal value.
m) The Ibiza Holiday is non-transferable and no cash alternative will be offered for the Ibiza Holiday (including if the Winner goes on the Ibiza Holiday alone).
6.8 For the avoidance of doubt, the Ibiza Holiday will be forfeited if the Winner:
a) is unable to take the Ibiza Holiday within the dates specified by the Promoter;
b) has not obtained the proper travel documents by the date specified by the Promoter;
c) has any immigration complications which prevent them from entering, leaving, or travelling within the dates specified by the Promoter;
d) has any medical, legal or any other reason that would prevent them from accepting or participating in the Ibiza Holiday;
e) for any other reason as set out in these Terms; or
f) if the Promoter, in its sole discretion, determines that awarding the Ibiza Holiday would be unsafe, impractical, or otherwise inappropriate for any reason not specifically mentioned herein.
6.9 In the event that the Ibiza Holiday is forfeited by the Winner, a new Winner will be chosen at random in accordance with these Terms.
7. Winner Selection
The Winners of the monthly digital camera prizes and the Ibiza Holiday will be selected at random by Element, using an automatic computer process from all valid entries. The Winners will then be contacted by Element via email and, in the case of the Ibiza Holiday, further details about how to book the Ibiza Holiday will be provided. Where a Winner fails to respond to this email or any other emails received from Element within 10 working days, a new Winner be chosen at random via the same process.
8. Personal Data
8.1 Personal data which is provided by entrants on entering the Promotion will be processed and stored in a database by Element for the purpose of managing entry into the Promotion on the Promoter’s behalf. By providing personal information, entrants consent to the processing and storage of personal information by Element for this purpose. Element’s privacy policy is available here.
8.2 All personal data will be deleted within 30 days of the date when the Ibiza Holiday ends. Consents can be withdrawn or amended at any time by emailing [email protected]. If an entrant withdraws consent to the storage and processing of their data for the purposes of administering the Promotion, they will also be withdrawn from the Promotion itself.
8.3 In the event that a reasonable request is made, including by the Advertising Standards Authority or any other competent body, Element will provide the surname and county of residence of the Winner of the Ibiza Holiday.
9. General
9.1 The Promoter accepts no responsibility for entries or claims for the Prizes that are lost, delayed, or damaged for any reason whatsoever.
9.2 Incomplete entries or those not in accordance with the entry instructions will not be accepted.
9.3 Entrants agree that, to the extent permissible by law, the Promoter, its affiliates and agents assume no liability for injuries, losses or damages or any kind to property or persons, including without limitation death, resulting in whole or part, directly or indirectly, from the management of or mechanics behind the Promotion, entry into the Promotion, the acceptance of the Prizes, and any acts or omissions of the Winner and their companion. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.
9.4 In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of the Prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the Promotion or these terms and conditions, at any stage, but will always endeavour to minimise the effect to the entrants in order to avoid undue disappointment.
9.5 The Promoter reserves the right to exclude any entries that it reasonably believes to be fraudulent or based on misconduct.
9.6 The Promoter (or Element on the Promoter’s behalf) reserves the right to verify all entries including but not limited to asking the Winners for proof of purchase and address and asking the Winner and their companion for age and identity details (which they must provide within 10 working days) and to refuse to award the Prizes or withdraw entitlement to the Prizes and/or refuse further participation in the Promotion and disqualify the entrant or Winner where there are reasonable grounds to believe there has been a breach of these Terms or any instructions forming part of these Terms or otherwise where an entrant has gained unfair advantage in participating in the Promotion. The Promoter will be the final arbiter in any decisions, and these will be binding and no correspondence will be entered into in relation this clause.
9.7 These Terms (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
